Terms of Service

By using SwimFolio, you agree to be bound by these Terms of Service. If you do not agree with these Terms, you may not use SwimFolio.

SwimFolio may update these Terms from time to time. Paying customers will be notified through the email address on record when a material change is made.

Account Terms

You must be at least 18 years old and authorized to act for the organization that uses the account.

You are responsible for the security of your account and for all activity performed through your organization's accounts. SwimFolio is not responsible for loss or damage caused by your failure to protect account credentials or remove access that is no longer authorized.

You are responsible for all reports, swimmer information, logos, curriculum materials, messages, notes, and other content uploaded or created through your account.

You are responsible for securing the rights and permissions needed to use all curriculum materials, including level names, skill requirements, and logos, that you provide to SwimFolio.

You are responsible for having the authority and any required parent or guardian permission to enter and use swimmer information, including information about minors.

You may not use SwimFolio for illegal or unauthorized purposes, including violating copyright, trademark, privacy, or other laws.

Report Terms

Your organization is responsible for reviewing every report before it is published. Families can view a report only after an authorized Director or Administrator publishes it.

Plus and Gold may include automated comment drafting. Gold may also include automated report review. Automated results may be incomplete or inaccurate. Your organization remains responsible for the final report and for deciding what is published.

Payment Terms

SwimFolio offers Basic, Plus, and Gold plans. The current features and per-report price for each plan are shown before payment setup and in the Director's SwimFolio plans page.

The Service is billed monthly based on reports first published to families during the billing period. Each report is billed only once. Drafting, editing, importing, reviewing, using automated tools, or republishing the same report does not create another report charge.

Eligible new organizations may receive one complete monthly billing period of Gold features at the Basic per-report price. The Director chooses which plan will begin after that introductory period.

Payments are processed through Stripe. SwimFolio does not receive or store complete card or bank-account numbers.

If payment is not received, SwimFolio may provide a grace period and then pause new report publishing and automated features until the account is brought current. Existing records and previously published reports will not be deleted only because a payment is late.

Cancellation and Termination

You may cancel your account at any time by emailing sales@myswimfolio.com. Please indicate whether you want published reports to remain available during any approved data-export period.

A final invoice will be created for all unbilled reports and applicable taxes through the cancellation date. Customer data will then be handled according to the Privacy Policy and SwimFolio's approved retention schedule.

SwimFolio may suspend or terminate an account for nonpayment, illegal use, a security risk, or a material violation of these Terms.

General Conditions

Your use of the Service is at your own risk. The Service is provided on an 'as is' and 'as available' basis to the maximum extent permitted by law.

Technical support is provided to paying customers through support@myswimfolio.com and is available in English.

You understand that SwimFolio uses third-party vendors and hosting partners to provide the hardware, software, networking, storage, payment processing, email delivery, and automated features required to operate the Service.

These Terms are governed by the laws of NJ. Questions about these Terms may be sent to support@myswimfolio.com.
